Verdicts Upheld on Appeal

July 10, 2008

We have received word from the prosecutor that both appeals to overturn the convictions of the murderers were denied.  We hope this is the end but they could try something else.

 

 

 
July 14, 2006
GUILTY OF FIRST DEGREE MURDER; ARMED ROBBERY AND ARSON.  BOTH JURIES WERE OUT FOR LESS THAN ONE HOUR.  THIS WAS AFTER 30 WITNESSES TESTIFED AND 130 PIECES OF EVIDENCE WERE PRESENTED.  THEY BOTH WILL BE SENTENCED ON AUGUST 11 TO LIFE WITHOUT PAROLE.

IT STILL HURTS LIKE HELL!

All the motions were heard on this day and we will be going to trial the week of July 10th.  The juries will be picked on Monday the 10th.  The actual trial will start on Tuesday, probably around 10 - 11.  It is hard to tell based on the judges schedule in the morning.  I will update this again on July 10 after the juries are picked.  Thank you for all your thoughts, prayers and support.

The judge handed down his decision to suppress the evidence in Biloxi today, and he ruled in our favor.  All the evidence found in the hotel room where the girl was found will be admissable.  These items include the murder weapon, a box of Brandon's video games and bloody clothing.

The trial is still schduled for the week of Juy 10.  A final pre-trial hearing is scheduled for July 6 for last minute motions to be heard.  It doesn't appear that there will be any delays.  Hopefully,  this part of the nightmare will be over soon.
 
June 26, 2006

We are still waiting for the ruling from the Judge on the Motion to Suppress the evidence obtained in Biloxi.  The hearing on June 9 was postponed until June 20, and at the hearing on June 20 the judge said he would make his final ruling on June 29.  We are still hoping the trial will take place the week of July 10.  If it gets delayed for any reason then the next available date won't be until the week of August 28.

We don't even know who is reading this,  since there are very few postings from people we know.  We know there are five people who are getting notified whenever there is an update.  Hopefully, more than those five people are checking this website out occasionally for updates.  Since the trial is fast approaching, we are hoping that Brandon's friends and family can attend all or part of the trial.  If it does start the week of July 10, the first day will be devoted to picking the jury.  The trial itself will probably not start until late morning, since the judge has calender call in the mornings.  The prosecutor has told us that it makes a big impression on the jury when family and friends of the victim attend the trial.  If anyone who is reading this would like to be kept informed of up to date information regarding the trial please emal this site manager.

The hearing that had been cancelled on April 21 was held today.  This is the hearing on the defendents motion to suppress the evidence found in the Biloxi hotel room.  It lasted approximately 2 1/2 hours. 

The prosecution called four witnesses, all police officers.  The most difficult testimony to hear was from the lead detective from Jacksonville because he recounted what he found the night Brandon was killed and how he was killed.  It was like reliving that nightmare all over again.  I guess that is just a little sample of what it will be like at the trial.  The defendents were both there and showed no emotion.  The judge requested briefs be filed by both sides and then he will hear final arguments on June 9. 

We have a trial date the week of July 10. We're hoping it will actually take place, but a lot will depend on what happens on June 9.

A hearing was supposed to be held today to determine weather the evidence obtained in the Biloxi hotel room would be admissable.  This would have been the first time that the defendents would have seen each other since being arrested.  This also would have been the first time we would have heard anything more substantial than a couple of comments before the judge about the progress of depositions, that usually lasts about 5 minutes.

Each time a hearing comes up the anxiety level builds up, at least mine does.  This one was more disturbing because this was the first time we were going to be the only  people in the same courtroom with the defendents for a lengthy period of time.  Also, this was a very important hearing to determine if key evidence was going to be admissable.  Unfortunately, the hearing didn't take place.  I got a call a 1:45, the hearing was at 2:30, from the prosecutor telling me one of the defense attorneys was involved in a car accident and the hearing was cancelled.  He didn't know if  the attorney was injured or when the hearing would be held.

So now we go through all this again. 


 
March 8 & 9, 2006

We attended the pre-trial hearings for each of the suspects on these dates.  It is extremely difficult to be in the same room with the last people who saw your child alive and not have feelings of anger and revenge.  Life in prison will be too good for them. 

The depositions in Biloxi went well, according to the DA.  Now there is a motion being filed by the defense attorneys to suppress the evidence found when the suspects were arrested there .  The hearing for this motion is scheduled for April 21.  

It is highly unlikely that the trial will begin on May 15. 

 
December 8 & 9 2005
We attended the pre-trial hearings on 12/8 & 12/9. They are held on separate days so the suspects don't get to see each other or talk to each other.  A trial date has been set for May 15, 2006.  It would be unusual if the cases actually went to trial the first time they were set.   The attorneys have scheduled depositions in Biloxi for February.
This is where the suspects were apprehended after fleeing in Brandon's car.   The next pre-trials are set for March 9 & March 10.  We are in Courtroom 8 at 9:00 a.m. if anyone would like to come. It is open to the public.  (Acutually, we never start until about 9:45.)  Some people asked us why we go to each of the hearings, they only last about 10 minutes.  We go to show these suspects and the judge that there are people who care about Brandon and are going to make sure there is justice.  We couldn't be there when he died but we can be there now.
 
2004
Brandon was murdered on December 18, 2004 at the age of 22 in his own apartment.  The suspects were acquaintances of his roommate of two years who was moving and needed someone to cover the lease for another month.  He was killed less than a week after they moved in.  Since the case is pending we cannot go into many details until the trials are over.  We just want it to be known that Brandon had nothing to do with this act of evil.  He tried to be a friend to his roommate and  these people and he paid with his life.

This time line is going to be used to keep family and friends updated on the trial of the animals accused of murdering Brandon.
